Covert Video Surveillance

So, you want to install a hidden camera in the condominium corporation's garbage room to determine who is loitering. Did you consider the Personal Information Protection and Electronic Documents Act ("PIPEDA"), and other privacy considerations?

While there is still uncertainty as to whether PIPEDA applies to condominium corporations, it is best to err on the side of caution and act as though PIPEDA does not apply, and to consider: what is the reason for collecting an individual's personal information though covert video surveillance? Does it qualify as a reasonable exception to collect such information without the consent of the individual? Should there be a policy in place regarding covert video surveillance?
