Fines and penalties are used as a means to ensure compliance in society. However, unless prescribed under the Condominium Act, 1998, fines and penalties do not apply in the world of condominiums. Although there was a demand to allow condominiums to issue fines and penalties, when an owner/resident breaches the provisions of the condominium corporation’s governing documents (i.e. declaration, by-laws and/or rules), the proposed amendments to the Condominium Act, 1998 prohibit same. All is not lost, as a condominium may still rely upon its indemnity provisions to potentially recover the costs it is forced to incur when owners/residents refuse to comply.
