CONDOBYTE - Barbecues and Balconies

With summer fast approaching, many unit owners will consider using barbecues on their balconies. It is important for condominium corporations to advise residents as to whether barbecue use is permitted. Many condominium corporations restrict the use of barbecues on balconies due to a perceived increased risk of fire and the potential for smoke and other odours entering neighbouring units.

It is important that condominium corporations review their declaration, by-laws and rules to ensure that no prohibition exists against the use of barbecues on balconies. It is also important to ensure that the condominium corporation is adhering to any applicable municipal by-laws which may restrict the use of barbecues on balconies.

Condominium corporations that allow the use of barbecues on balconies can minimize the fire risks associated with barbecue use by passing a rule prohibiting propane-fuelled barbecues and only allowing electric barbecues. Condominium corporations may also consider passing rules mandating the upkeep of barbecues and requiring a certificate from a fuels-related technician certified by the Technical Standards and Safety Authority to be filed with the condominium corporation annually indicating that the barbecue and propane cylinder are in good working order.
