Did You Know......Duty to Accommodate

A condominium corporation has a duty to accommodate disabled owners. In a nutshell, the law provides that disabled residents should have an equal opportunity as able bodied owners to use the common elements. A recent case suggests that the duty to accommodate may extend into such owner’s unit and may require the condominium corporation to finance changes to such unit, or the inspection and cleaning of the unit. For further information, contact Jonathan Fine.
