A condominium corporation has obligations under PIPEDA to maintain the personal information of unit owners and employees as confidential. Therefore, references made in board meeting minutes to individual unit owners and employees should be blacked-out prior to such minutes being provided to a party under Section 55 of the Condominium Act, 1998. For example, if a unit owner has a dispute with the condominium corporation and that issue is discussed in a board meeting, or if the board resolves to give a warning to an employee, such references should be deleted prior to providing access to minutes as part of the corporate records under Section 55. If your condominium corporation receives many requests for records, it may make sense to have two sets of hard copies, one as the unaltered originals and another tat can be reviewed by owners upon request under Section 55.
